Arbitration and mediation services often prove to be a more practical and less expensive way to resolve commercial disputes. Whether such a method of dispute resolution is stipulated by contract, ordered by the court, or agreed upon by both parties, arbitration and mediation have the goal of achieving a fair result without the necessity of costly litigation. It is important to have an experienced mediator or arbitrator who will listen carefully to both sides, weigh the evidence in the case, and guide the parties toward a fair settlement or result.
When you hire CAMS, our attorneys will schedule a mediation session and request the relevant evidence in the case from both sides. During the session, our mediator will guide the process, but each side, and their attorney, will have the opportunity to present their case. If we are successful in reaching a settlement agreement, our mediator will draft the agreement and have each party and their attorney sign it. Our goal is to achieve a settlement that is fair to both parties. Even in those less-common cases where the mediation session does not result in a settlement, the parties often still find that the experience is valuable, in that it may lay the groundwork for a future settlement during the litigation process.
