Biography and Practice Experience
Brad was born, raised, and educated right here in Louisville. After graduating from duPont Manual High School, Brad attended the University of Louisville, earning degrees in Political Science and History in 2006, and completing a dual J.D./M.A. Political Science degree program through the Brandeis School of Law in 2010. In law school, Brad was a member and editor of the Journal of Law and Education, and an Academic Fellow.Brad has been with Conliffe, Sandmann & Sullivan, starting as a law clerk and later as an associate, since May 2009. Since that time, he has successfully prosecuted and defended civil cases in several areas:
Construction Litigation:
- Obtained summary judgment for a general contractor on a subcontractor’s multi-million dollar inefficiency claim in connection with the construction of a new hospital (case settled prior to appeal).
- Brought claim against roofing subcontractor and surety for roof leaks and resulting damage to church additions and renovations.
- Represented homeowners in suit against installer and manufacturer of defective flooring.
- Defended residential/commercial roofing company in litigation by owner of multi-million dollar residence destroyed by alleged lightning strike, obtaining summary judgment.
Employment Litigation:
- Defended municipal and private entities against claims of discrimination/retaliation based on race, age, disability, and worker’s comp filings, winning summary judgments in multiple cases.
- Participated in successful prosecution of sexual harassment claims, unemployment hearings, wage and hour claims, and employment contract claims.
Tort Litigation:
- Won summary dismissal of product defect/warranty case, representing manufacturer of ink (federal court).
- Successfully defended appeal on claims of defamation and invasion of privacy on behalf of government communications officer.
- Defeated motion for judgment on the pleadings and favorably settled defect claim brought on behalf of regional trucking company.
Public Contracts/Procurement:
- Won summary judgment, affirmed on appeal, representing state agency in litigation with private Medicaid contractor regarding coverage of claims for school nurse services.
- Assisted in other bid contest and procurement litigation for Finance & Administration Cabinet.
Business and Commercial:
- Participated in check fraud litigation against major nationwide bank, resulting in favorable settlement.
- Assisted in bringing claim under the Kentucky Business Opportunities Act on behalf of startup business client, winning a judgment, and successfully defeated the judgment debtor’s efforts to discharge the debt in bankruptcy.
- Acted as local counsel for the preparation and filing of mortgages, fixture filings and amendments thereto on behalf of international congolmerate engaged in complex multi-lender loan transaction.
Brad also has experience prosecuting securities fraud and suitability claims, litigation associated with partnership, LLC, and non-profit business transitions and dissolutions, UCC issues (warranties, negotiable instruments, letters of credit, and secured transactions), landlord/tenant issues, and insurance coverage disputes (CGL, Builder’s Risk, UM/UIM).
